Inquiries and Hearings
The Board investigates and conducts inquiries and hearings into complaints and other matters related to the good character, competence, and fitness to teach of registered teachers in Tasmania. When necessary, the Board establishes Committees of Inquiry (pursuant to Section 21 of the Teachers Registration Act 2000 – the Act) to conduct inquiries and hearings.
The role of a Committee of Inquiry is to consider the evidence and determine the facts of matters arising from complaints and notifications from employers to the Board about registered teachers. A Committee of Inquiry consists of sitting Board members and practicing teachers.
The Board is to give a person notice in writing of:
(a) any decision it makes that affects that person or a person employed by that person
(b) the reasons for that decision.
A person may apply to the Magistrates Court (Administrative Appeals Division) for a review of a decision that the person is given notice of under Section 28 of the Act.
Section 29 subsection (2) amended by No. 79 of 2009, S.18, applied 1 January 2010: In addition to any other order or power it may make or exercise in determining the application, the Magistrates Court (Administrative Appeals Division) may order the Board to take an action under Section 18A, 24, or 26 of the Act.
